The Department of Health and Human Services, Office for Civil Rights enforces Section 504 of the 1973 Rehabilitation Act and Title II of the Americans with Disabilities Act. OCR works through complaint investigations and compliance reviews, as well as outreach, technical assistance, and public education to promote voluntary compliance. In the Olmstead decision of June 1999, the Supreme Court held that the ADA’s “integration regulation” requires state and local government to administer services, programs, and activities in the most integrated setting (...) appropriate to the needs of qualified individuals with disabilities. The decision changed the focus from whether a right to more integrated services exists, to under what circumstances and how services will be provided. The New Freedom Initiative announced by President Bush in February 2001 is a broadbased initiative to remove barriers to community living for people with disabilities and promote swift implementation of the Olmstead decision. In this review of the Korean cloning scandal involving Woo-Suk Hwang, the nature of the disaster is documented and reasons why it occurred are suggested. The general problems it raises for scientific research are highlighted and six possible ways of improving practice are offered in the light of this case: better education of science students; independent monitoring and validation; guidelines for tissue donation for research; fostering of debate about ethically contentious research in science journals; development of an international code of (...) ethical research practice; fostering of public involvement in ethical review and debate through the web. Patients who are dying of cancer usually give up eating and then stop drinking. This raises ethical dilemmas about providing nutritional support and fluid replacement. The decision-making process should be based on a knowledge of the risks and benefits of giving or withholding treatments. There is no clear evidence that increased nutritional support or fluid therapy alters comfort, mental status or survival of patients who are dying. Rarely, subcutaneous fluid administration in the dying patient may be justified if the family (...) remain distressed despite due consideration of the lack of medical benefit versus the risks. Some cancer patients who are not imminently dying become dehydrated from reversible conditions such as hypercalcaemia. This may mimic the effects of advanced cancer. These conditions should be sought and fluid replacement therapy should be given along with the specific treatments for the condition. (shrink)

Responsible research and innovation has come to represent a change in the relationship between science, technology and society. With origins in the democratisation of science, and the inclusion of ethical and societal aspects in research and development activities, RRI offers a means of integrating society and the research and innovation communities. In this article, we frame RRI activities through the lens of layers of science and technology governance as a means of characterising the context in which the RRI activity is (...) positioned and the goal of those actors promoting the RRI activities in shaping overall governance patterns. RRI began to emerge during a time of considerable deliberation about the societal and governance challenges around nanotechnology, in which stakeholders were looking for new ways of integrating notions of responsibility in nanotechnology research and development. For this reason, this article focuses on nanotechnology as the site for exploring the evolution and growth of RRI. (shrink)

This is a study involving three HIV clinics in the Canadian provinces of Newfoundland and Labrador, and Manitoba. We sought to identify ethical issues involving health care providers and clinic clients in these settings, and to gain an understanding of how different ethical issues are managed by these groups. We used an institutional ethnographic method to investigate ethical issues in HIV clinics. Our researcher conducted in-depth semi-structured interviews, compiled participant observation notes, and studied health records in order to document ethical (...) issues in the clinics, and to understand how health care providers and clinic clients manage and resolve these issues. We found that health care providers and clinic clients have developed work processes for managing ethical issues of various types: conflicts between client-autonomy and public health priorities, difficulties associated with the criminalization of nondisclosure of HIV positive status, challenges with non-adherence to HIV treatment, the protection of confidentiality, barriers to treatment access, and negative social determinants of health and well-being. Some ethical issues resulted from structural disadvantages experienced by clinic clients. The most striking findings in our study were the negative social determinants of health and well-being experienced by some clinic clients – such as experiences of violence and trauma, poverty, racism, colonization, homelessness, and other factors affecting well-being such as problematic substance use. These negative determinants were at the root of other ethical issues, and are themselves of ethical concern. (shrink)

The purpose of this article is to invigorate debate concerning the nature of analogy, and to broaden the scope of current conceptions of analogy. We argue that analogizing is not a single or even a fundamental cognitive process. The argument relies on an analysis of the history of the concept of analogy, case studies on the use of analogy in scientific problem solving, cognitive research on analogy comprehension and problem solving, and a survey of computational mechanisms of analogy comprehension. Analogizing (...) is regarded as a macrocognitive phenomenon having a number of supporting processes. These include the apperception of resemblances and distinctions, metaphor, and the balancing of semantic flexibility and inference constraint. Psychological theories and computational models have generally relied on (a) a sparse set of ontological concepts (a property called “similarity” and a structuralist categorization of types of semantic relations), (b) a single form category (i.e., the classic four-term analogy), and (c) a single set of morphological distinctions (e.g., verbal vs. pictorial analogies). This article presents a classification based on a “naturalistic” exploration of the variety of uses of analogical reasoning in pragmatically distinct contexts. The resultant taxonomy distinguishes pre-hoc, ad-hoc, post-hoc, pro-hoc, contra-hoc, and trans-hoc analogy. Each will require its own macrocognitive modeling, and each presents an opportunity for research on phenomena of reasoning that have been neglected. (shrink)

This is a description of an avian-shaped feature that rests below a network of cellular structures found on a mound within the Argyre Basin of Mars in Mars Global Surveyor image M14-02185, acquired on April 30, 2000, and released to the public on April 4, 2001. The area examined is located near 48.0° South, 55.1° West. The formation is approximately 2,400 meters long from the tip of its beak to the tip of its farthest tail feather. There is a minimum (...) of six different variations in appearance of the surface material over this small area. Utilizing the public targeting request form provided on the Mars Global Surveyor (MGS) website, co-author Miller secured a second image of the area that was obtained on July 3, 2006, showing this feature under different conditions S20-00165. The new image was then released to the public on August 11, 2006. A third image of the formation identified as MGS S13-01480 was acquired on December 15, 2005, and although officially processed on June 20, 2006, it was not made available to the public until August 22, 2009, on NASA’s Planetary Data System (PDS) website. All three of the MGS images reveal defining aspects of this avian feature, including a head, beak, body, eye, leg, foot, toes, wing, and feathers. When taken together, these components induce the visual impression of an avian-shaped formation that exhibits a unique set of proportional features. Adjoining this formation is a composite of complex cellular features that form a compartmentalized infrastructure. The three authors who are veterinarians provide a critical analysis of the avian features, and the geologist and geoscientist authors examine natural mechanisms that could contribute to the formation of this feature. An extensive search of comparable regions within and beyond the area of the Argyre Basin was conducted. A list of these sites is provided, and terrestrial comparisons are also offered. (shrink)

It is often suggested that during development the brain barriers are immature. This argument stems from teleological interpretations and experimental observations of the high protein concentrations in fetal cerebrospinal fluid (CSF) and decreases in apparent permeability of passive markers during development. We argue that the developmental blood–CSF barrier restricts the passage of lipid‐insoluble molecules by the same mechanism as in the adult (tight junctions) rendering the paracellular pathway an unlikely route of entry. Instead, we suggest that both protein and passive (...) markers are transferred across the epithelium through a transcellular route. We propose that changes in volume of distribution can largely explain the decrease in apparent permeability for passive markers and that developmentally regulated cellular transfer explains changes in CSF protein concentrations. The blood–CSF tight junctions are functionally mature from very early in development, and it appears that transfer from blood into embryonic brain occurs predominately via CSF rather than the vasculature. A substantial body of evidence suggests that autobiographical recollection and simulation of future happenings activate a shared neural network. Many of the neural regions implicated in this network are affected in patients with bipolar disorder , showing altered metabolic functioning and/or structural volume abnormalities. Studies of autobiographical recall in BD reveal overgeneralization, where autobiographical memory comprises primarily factual or repeated information as opposed to details specific in time and in place and definitive of re-experiencing. To date, no study has examined (...) whether these deficits extend to future event simulation. We examined the ability of patients with BD and controls to imagine positive, negative and neutral future events using a modified version of the Autobiographical Interview that allowed for separation of episodic and non-episodic details. Patients were selectively impaired in imagining future positive, negative, and neutral episodic details; simulation of non-episodic details was equivalent across groups. (shrink)

Bovine fetuin, the first fetal protein to be described, has recently been shown to be a species homologue of a well known human plasma protein ‐ α2HS glycoprotein (α2HS). The fetuins are now known to be members of the cystatin superfamily. The structural properties of the six fetuins that have been fully sequenced are compared. Despite the structural homology of these proteins, their described properties in the literature make them appear to be quite different. The diverse in vitro properties claimed (...) for fetuin/α2HS are reviewed. In vivo, fetuins are involved in the acute phase response. In development, in all species studied so far, fetuins are present in a specific cell population that forms the developing neocortex. Consider the following three propositions: (R) Artworks necessarily have aesthetic properties that are relevant to their appreciation as artworks. (S) Aesthetic properties necessarily depend, at least in part, on properties perceived by means of the five senses. (X) There exist artworks that need not be perceived by means of the five senses to be appreciated as artworks. The independent plausibility and apparent joint inconsistency of these three propositions give rise to what I refer to as ‘the problem of non-perceptual art’. (...) Assuming that the propositions are independently plausible and jointly inconsistent, there will be three ways of solving the problem: you may affirm (R) and (S) while denying (X); you may affirm (S) and (X) while denying (R); or you may affirm (R) and (X) while denying (S). The first of these, once the orthodox solution, has been displaced in recent years by the second. The third has never really been defended. I defend it here. If successful, my defence will have shown that there is reason to deny the existence of non-aesthetic art and no reason to believe that art is not essentially aesthetic. (shrink)

Saunders & van Brakel argue, inter alia, that there is for the claim that there are four unique hues (red, green, blue, and yellow), and that there are two corresponding opponent processes. We argue that this is quite mistaken.

Saunders Mac Lane has drawn attention many times, particularly in his book Mathematics: Form and Function, to the system of set theory of which the axioms are Extensionality, Null Set, Pairing, Union, Infinity, Power Set, Restricted Separation, Foundation, and Choice, to which system, afforced by the principle, , of Transitive Containment, we shall refer as . His system is naturally related to systems derived from topos-theoretic notions concerning the category of sets, and is, as Mac Lane emphasises, one that (...) is adequate for much of mathematics. In this paper we show that the consistency strength of Mac Lane's system is not increased by adding the axioms of Kripke–Platek set theory and even the Axiom of Constructibility to Mac Lane's axioms; our method requires a close study of Axiom H, which was proposed by Mitchell; we digress to apply these methods to subsystems of Zermelo set theory , and obtain an apparently new proof that is not finitely axiomatisable; we study Friedman's strengthening of , and the Forster–Kaye subsystem of , and use forcing over ill-founded models and forcing to establish independence results concerning and ; we show, again using ill-founded models, that proves the consistency of ; turning to systems that are type-theoretic in spirit or in fact, we show by arguments of Coret and Boffa that proves a weak form of Stratified Collection, and that is a conservative extension of for stratified sentences, from which we deduce that proves a strong stratified version of ; we analyse the known equiconsistency of with the simple theory of types and give Lake's proof that an instance of Mathematical Induction is unprovable in Mac Lane's system; we study a simple set theoretic assertion—namely that there exists an infinite set of infinite sets, no two of which have the same cardinal—and use it to establish the failure of the full schema of Stratified Collection in ; and we determine the point of failure of various other schemata in . If we are to posit, as do many liberal theorists, that autonomy is an educational goal that the state should endorse across cultural difference, key questions remain: What type of autonomy should we strive for, exactly, and how should this goal be achieved? Many liberal philosophers of education have argued that autonomy should enable cultural choice and that the development of autonomy requires students to be exposed to different beliefs and traditions. Shelley Burtt has challenged this dominant position, however, (...) insisting that autonomy (properly understood) can be developed within a “comprehensive education” that does not seek to sympathetically expose students to cultural difference. In this essay, Bryan Warnick responds that Burtt's arguments are inconsistent and lack cultural imagination, and that her underlying concept of autonomy is inadequate, primarily because it lacks a compelling picture of cultural self-criticism. There is a lack of appreciation, he argues, for how frameworks of cultural comparison are necessary in the development of this self-criticism. At the same time, Warnick argues that there is much to be learned from Burtt's analysis about the tough choices that need to be made as liberals seek to champion autonomy as an educational end across cultural difference. Zone theories of color vision transform cone sensitivities to channel sensitivities before transmitting these signals to the brain. The concepts of and are fundamental to an understanding of this transformation. Saunders & van Brakel question the objectivity of these concepts. Statements in their target article indicate that the reason for this questioning stems from a failure to appreciate the constraints inherent in the definitions of these concepts.

Recent articles by Michael Heller, Carl Helrich, Peter Hodgson, Jeffrey Koperski, and Nicholas Saunders present a challenge to much current thinking on God, divine action, and cosmology. In the process, they also reveal underlying assumptions and current problems, especially in the debate over physics and divine action. In particular, three issues come up that need to be addressed further. First, what is the status of determinism, and what can physics contribute? Second, what kind of divine action are we talking (...) about? Third, what is the relationship between God and time, and how does this affect claims about the personhood of God? While these essays present necessary critiques and interesting, positive proposals, they also reveal unresolved tensions that need to be addressed. (shrink)

In _Anarchist Prophets_ James R. Martel juxtaposes anarchism with what he calls archism in order to theorize the potential for a radical democratic politics. He shows how archism—a centralized and hierarchical political form that is a secularization of ancient Greek and Hebrew prophetic traditions—dominates contemporary politics through a prophet’s promises of peace and prosperity or the threat of violence. Archism is met by anarchism, in which a community shares a collective form of judgment and vision. Martel focuses on the figure (...) of the anarchist prophet, who leads efforts to regain the authority for the community that archism has stolen. The goal of anarchist prophets is to render themselves obsolete and to cede power back to the collective so as to not become archist themselves. Martel locates anarchist prophets in a range of philosophical, literary, and historical examples, from Hobbes and Nietzsche to Mary Shelley and Octavia Butler to Kurdish resistance in Syria and the Spanish Revolution. In so doing, Martel highlights how anarchist forms of collective vision and action can provide the means to overthrow archist authority. (shrink)

Two points are made on the basis of (mainly) the cross-cultural psychological record. The first is that cross-cultural data indicate at least weak, nontrivial constraints on colour classification. The second is that exceptions to cross-cultural regularities as described by Saunders & van Brakel are compatible with the view that constraints on colour categories are probabilistic rather than deterministic.
